Participant Terms & Conditions and Assumption of Risk Agreement

Event: Notting Hill Carnival

 

By purchasing a costume and/or participating with HOTWAX CARNIVAL MASS LTD (“the Band”) in the Notting Hill Carnival (“the Event”), you agree to the following Terms and Conditions.

 

1. Participation

Participation in the Event includes involvement in parade activities, associated celebrations, and related band events. Participants acknowledge that Notting Hill Carnival is a large public event involving crowds, music vehicles, alcohol consumption, and extended periods of standing, walking, and dancing.

 

Participation is voluntary and at your own risk.

 

2. Assumption of Risk

Participants acknowledge that involvement in the Event carries inherent risks, including but not limited to:

Slips, trips, and falls

Heat exhaustion or dehydration

Contact with large crowds

Noise exposure

Costume-related discomfort or minor injury

Alcohol-related risks

Transport vehicle proximity

 

Participants voluntarily assume all risks associated with participation and agree they are responsible for their own personal safety.

 

Nothing in this agreement excludes liability for death or personal injury caused by negligence, or any liability that cannot be excluded under UK law.

 

3. Health & Fitness

Participants confirm that they are physically fit and able to take part in a full-day street parade involving prolonged standing, walking, and dancing.

 

Participants are responsible for:

Staying hydrated

Managing personal medical conditions

Bringing any required medication

Informing the Band of any relevant health concerns where appropriate

 

The Band is not responsible for medical issues arising during participation.

 

4. Alcohol Policy

Alcohol may be provided by the Band to adult participants (18+ only). By accepting alcohol, participants agree to drink responsibly.

 

The Band reserves the right to:

Refuse alcohol service

Remove participants who appear intoxicated

Remove participants whose behaviour becomes unsafe

 

The Band is not liable for any injury, damage, or incident arising from alcohol consumption.

 

5. Kids & Family Participation (Sunday Only)

Participants under 18 must be accompanied by a responsible adult

Parents/guardians remain responsible for minors at all times

Alcohol is not provided to minors

The Band reserves the right to remove any child or guardian where safety concerns arise

 

6. Adult Parade (Monday Only)

Monday participation is strictly 18+ only. Proof of age may be requested.

 

7. Costume Collection & Responsibility

Participants are responsible for:

Collecting costumes at designated times

Ensuring correct fit

Wearing costumes safely

 

The Band is not liable for:

Discomfort

Minor costume-related injuries

Damage caused by incorrect use

Loss or damage after collection

 

Costumes remain the responsibility of the participant once collected.

 

8. Fees, Payments & Refunds

Participation fees are non-refundable except where:

The Band cancels participation entirely

 

No refunds will be issued for:

Non-attendance

Late arrival

Removal due to misconduct

Weather conditions

Route changes or delays

 

9. Conduct & Behaviour

Participants agree to:

Follow all instructions from Band staff and stewards

Behave respectfully toward other participants and the public

Avoid aggressive, unsafe, or disruptive behaviour

Comply with safety directions

 

The Band reserves the right to remove any participant without refund for:

Unsafe behaviour

Excessive intoxication

Harassment or violence

Non-compliance with instructions

 

10. Personal Belongings

Participants are responsible for their own personal belongings.

The Band accepts no responsibility for loss, theft, or damage.

 

Participants are encouraged to bring minimal valuables.

 

11. Photography & Media Consent

Participants grant HOTWAX CARNIVAL MASS LTD permission to use:

Photographs

Video recordings

Audio recordings

Likeness and name

 

for promotional, marketing, and media purposes without compensation.

 

12. Schedule & Event Changes

Participants acknowledge that Notting Hill Carnival schedules are subject to change. The Band is not responsible for:

Delays

Route changes

Weather disruptions

Police or organiser instructions

 

13. Medical Treatment Consent

Participants consent to receiving emergency medical treatment if required during the Event. Any associated costs remain the participant’s responsibility.

 

14. Release of Liability

To the fullest extent permitted by UK law, participants release and hold harmless HOTWAX CARNIVAL MASS LTD, its directors, staff, volunteers, and affiliates from any claims arising from participation in the Event, except where liability cannot legally be excluded.

 

15. Severability

If any provision of this agreement is found to be invalid, the remaining provisions shall continue in full force and effect.

 

16. Agreement

By purchasing a costume and/or participating in the Event, you confirm that you:

Have read and understood these Terms and Conditions

Agree to comply with them

Accept the risks associated with participation
